CONSTRUCTION LITIGATION

Peabody & Arnold has extensive experience representing parties to construction-related disputes. We represent owners (both public and private), architects, and other design professionals, general contractors, subcontractors, material suppliers, and sureties in disputes involving all aspects of construction projects.

Our practice includes the negotiation and drafting of design and construction management contracts, advising clients on contract interpretation and contract administration, claim avoidance, public procurement laws, labor and employment issues, OSHA, bid protests, claim management, and litigation and arbitration of construction matters. Our long history of representing surety companies on both public and private construction projects gives us a wealth of experience in restarting projects halted by defaulting contractors and subcontractors, and in complex litigation arising from distressed projects.

Our construction clients frequently call upon us for advice and assistance with construction disputes before they go into litigation. We have utilized a variety of techniques to avoid litigation, including renegotiating contracts to provide incentives for greater productivity and efficiency, assisting clients in identifying the source of the problems at issue, opening lines of communication previously obstructed, and developing decision trees to analyze the benefits and burdens of alternative courses of action.
