Peabody & Arnold LLP has been representing clients in the environmental law area for decades. Peabody & Arnold has participated in all aspects of negotiation with the United States Environmental Protection Agency, Massachusetts Department of Environmental Protection and other similar federal and state agencies on behalf of owners, operators, generators and transporters. Peabody & Arnold has both prosecuted and defended claims by private owners against persons allegedly responsible for existing or threatened onsite contamination. The firm has litigated numerous cases, including, but not limited to, claims of elevation of sodium and chloride levels in public and private drinking water supplies allegedly caused by the application of road salt as a de-icing agent on highways; the alleged contamination of rivers and streams due to the application of pesticides and herbicides; the representation of transporters and generators of hazardous waste and oil; the migration of methane gas from a landfill; the escape of hazardous waste and oil from underground storage tanks; the contamination of municipal water supplies; and mold claims made by building owners. Peabody & Arnolds representation of clients on environmental matters is both by way of direct representation of private clients and by way of referral of the defense of environmental claims from insurance carriers. Release or threat of release of hazardous materials under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) and the Massachusetts Oil and Hazardous Release Prevention and Response Act (M.G.L. 21E);
Claims involving violation of the federal and state Clean Water Acts;
Insurance coverage litigation;
Representation of environmental contractors, environmental engineers and consultants, and industrial hygienists on professional liability claims; and
Environmental claims arising out of construction projects.
