Peabody & Arnold enjoys a national reputation in the area of fidelity and surety law. Our attorneys handle cases throughout the country involving virtually every type of fidelity and financial institution bond, including commercial crime policies, brokers' blanket bonds, fiduciary bonds, and public official bonds. We have analyzed, researched, negotiated, or litigated nearly every major coverage issue arising under those bonds. The primary emphasis of our surety practice has been in the area of construction bonds, where we provide advice to sureties in connection with the myriad of problems relating to actual or threatened defaults of bonded principals, reletting of construction projects, complicated and multi-project work-outs, take-over and ratification agreements, and performance and payment bond claims. We also represent sureties and their employees in defending actions alleging unfair settlement of claims and/or bad faith. The Firm's surety expertise is considerably enhanced by the substantial knowledge of construction projects of our lawyers and their experience in construction-related trial practice. Our broad-based practice in these areas includes the representation of public and private owners, general contractors, subcontractors, material suppliers, architects and engineers.

Our approach to fidelity and surety issues is similar to our overall litigation philosophy: resolve the problem in the most cost-effective way possible. To this end, we make every effort to study the problem quickly and negotiate a resolution as rapidly as is feasible. We recommend and regularly make use of formal and informal alternative dispute techniques, including mediation, arbitration, issue severance and mini-trials.
