Allen David and Avana Epperson-Temple Obtain Jury Verdict at Recent Trial
Peabody & Arnold attorneys Allen David and Avana Epperson-Temple obtained a plaintiff’s verdict on behalf of their client law firm after a two-week jury trial in the Business Litigation Session of the Massachusetts Superior Court.
The plaintiff law firm brought claims for breach of contract and unjust enrichment against the defendant owner of a law practice. The parties entered into an agreement for the plaintiff to purchase the defendant’s law practice and eventually run the practice on its own after a set period of time. After the parties executed the agreement and the plaintiff began performing legal work for the law practice, the parties ended up parting ways and the defendant kept the law practice. The defendant asserted counterclaims for breach of contract, breach of fiduciary duty, breach of the covenant of good faith and fair dealing, and fraud in the inducement. The jury returned a complete plaintiff’s verdict after several hours of deliberations.
